How to get a Temporary Residence Card in Vietnam?

In the integration process like today, Vietnam has promoted attracting foreign human resources to come and work in Vietnam. Foreigners who have a work permit or a work permit exemption certificate with a term of 12 months or more in accordance with regulations are granted temporary residence card, the duration of the Temporary Residence Card depends on the validity period of the work permit. What is a Vietnam Temporary Residence Card (TRC)?

According to the Law Entry, Exit, Transit, Residence of foreigners in Vietnam 2014, temporary residence card is a type of document issued by the immigration management agency or the competent agency of the Ministry of Foreign Affairs to the foreigner. Foreigners are allowed to reside in Vietnam for a definite time.

Legal documents guiding the procedure for granting Temporary Residence Cards

– Law on entry, exit, transit and residence of foreigners in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014).

– Circular No. 04/2015/Tt-BCA, Dated January 5, 2015 Of The Ministry Of Public Security Stipulating The Form Of  Regulations On Specimen Papers Concerning Foreigners Entering, Leaving And Residing In Vietnam

– Circular No. 219/2016/TT-BTC dated November 10, 2016 of the Ministry of Finance stipulating the regime of collection, payment, management and use of fees and charges in the field of exit, entry, transit and residence in Vietnam.

Requirements and conditions for being granted a temporary residence card

– Passport valid for 1 year or more.

– Proof of being granted a temporary residence card of a foreigner with a validity of at least 01 year or more (eg work permit,…)

Required documents to apply for a Temporary Residence Card in Vietnam

  1. The guarantor’s written request for temporary residence card for foreigners (Form NA6 for agencies and organizations; Form NA7 for individuals)
  2. Information form for issuance of temporary residence card with photo 3cm x 4cm (Form NA8)
  3. Copy of valid passport and visa (bring the original for comparison);
  4. 02 photos 3*4cm (01 photo to paste on the Information Sheet, 01 photo to save separately)
  5. Depending on the circumstances, one of the following is required:

– 01 copy of the business registration certificate of the guarantor agency, organization or enterprise.

– Work permit orWork permit exemption certificate;

– If applying for a temporary residence card in Vietnam without a work permit:

investment certificates

– License for establishment of representative office or branch of the company

– Certificate of Board of Directors member

– Birth certificate, marriage registration certificate, household registration … If you apply for a temporary residence card for your spouse, children, etc., you are a foreigner.

Declaration of temporary residence or Certificate of temporary residence in the locality bearing the seal of the commune-level police department.

How to perform:

Step 1: Prepare documents as required by law.

Step 2: Submit:

1. Agencies, organizations and individuals submit dossiers at one of the two working offices of the Immigration Department – the Ministry of Public Security:

a) 44-46 Tran Phu, Ba Dinh, Hanoi.

b) 333-335-337 Nguyen Trai, District 1, Ho Chi Minh City.

2. The officer receiving the application shall check the legality and content of the application:

– If it is complete and valid, then receive the application, print and hand over the receipt, and schedule a date to return the results.

– If the dossier is not valid, the dossier-receiving officer shall guide the applicant to supplement the dossier for completeness.

Application submission time:

– From Monday to Saturday morning (except New Year and public holidays).

Step 3: Get results:

a) The person who comes to receive the result gives the receipt, identity card or passport to the officer who returns the results of the examination and comparison. receive and hand over the temporary residence card to the person who comes to receive the result (even if it is not resolved).

b) Time to return results:

From Monday to Friday every week (except New Year and public holidays).

Deadline for settlement: within 05 working days from the date of receipt of complete dossiers.

Term of Temporary Residence Card of foreigners in Vietnam

– The duration of the temporary residence card issued is at least 30 days shorter than the remaining validity of the passport;

– Temporary residence card with symbol DT1 is valid for not more than 10 years;

– Temporary residence cards with symbols NG3, LV1, LV2, LS, DT2 and DH are valid for no more than 5 years;

– Temporary residence cards with symbols NN1, NN2, DT3, TT are valid for no more than 03 years;

– Temporary residence cards with symbols LD1, LD2 and PV1 are valid for no more than 02 years;

– Expired temporary residence card will be considered for a new card.

In case of complete documents in accordance with Vietnamese law
