Many workers have claimed legal and legitimate benefits from the support of the Ho Chi Minh <\/span>City<\/span> Labor <\/span>Federation<\/span><\/a> Legal<\/span><\/a> Consultancy Center<\/span><\/span><\/h2>\n

Owing <\/span>more<\/span> than<\/span> 500 <\/span>million<\/span> VND <\/span>in<\/span><\/a> salary<\/span><\/a>, <\/span>the<\/span><\/a> business<\/span><\/a> suddenly<\/span><\/a> closed <\/span>and<\/span><\/a> “disappeared”.<\/span>This<\/span><\/a> makes <\/span>the<\/span><\/a> collective<\/span><\/a> of<\/span><\/a> workers <\/span>of<\/span><\/a> Myoung Jin Vietnam <\/span>Co<\/span><\/a>., <\/span>Ltd<\/span><\/a>. (Hoc <\/span>Mon<\/span><\/a> district<\/span><\/a>, Ho Chi Minh <\/span>City<\/span><\/a>) bewildered. <\/span>Recently<\/span><\/a>, <\/span>through<\/span><\/a> the Legal Counseling Center of the Ho Chi Minh City Labor Federation’<\/span>s<\/span><\/a> advice<\/span><\/a> and<\/span><\/a> guidance<\/span><\/a>, <\/span>some<\/span><\/a> workers are carrying <\/span>out<\/span><\/a> procedures <\/span>to<\/span><\/a> sue<\/span><\/a> businesses in <\/span>court<\/span><\/a> to<\/span><\/a> claim<\/span><\/a> their<\/span><\/a> rights<\/span><\/a>.<\/span><\/p>\n

Patience for workers<\/b><\/p>\n

Mr. Hoang Diep Thanh, a worker <\/span>of<\/span><\/a> Myoung Jin Vietnam <\/span>Co<\/span><\/a>., <\/span>Ltd<\/span><\/a>., said <\/span>this<\/span><\/a> was <\/span>the<\/span><\/a> first<\/span><\/a> time<\/span><\/a> they<\/span><\/a> had encountered <\/span>such<\/span><\/a> a<\/span><\/a> situation<\/span><\/a>. <\/span>Because<\/span><\/a> legal<\/span><\/a> knowledge<\/span><\/a> is <\/span>limited<\/span><\/a>, <\/span>the<\/span><\/a> workers’ <\/span>collective<\/span><\/a> doesn\u2019t\u00a0 <\/span>know<\/span><\/a> how<\/span><\/a> to<\/span><\/a> do<\/span><\/a> it<\/span><\/a>. “<\/span>With<\/span><\/a> the<\/span><\/a> guidance<\/span><\/a> of<\/span><\/a> the<\/span><\/a> center’<\/span>s<\/span><\/a> officials, <\/span>we<\/span><\/a> know<\/span><\/a> the<\/span><\/a> process<\/span><\/a> and<\/span><\/a> procedures <\/span>for<\/span><\/a> initiating lawsuits <\/span>and<\/span><\/a> are <\/span>more<\/span><\/a> confident<\/span><\/a> in<\/span><\/a> claiming <\/span>our<\/span><\/a> rights<\/span><\/a>,” Mr.Thanh said.<\/span><\/p>\n

Before that, many employees also sought help from the Ho Chi Minh <\/span>City<\/span><\/a> Labor <\/span>Federation<\/span><\/a> Legal<\/span><\/a> Consultancy Center for help when starting the lawsuit process and many people have regained their legitimate rights.\u00a0 For example, in the case of Mrs. Nguyen Thi Thao, an office worker of V.S Co., Ltd. (Cu Chi district, Ho Chi Minh City), not long ago. Ms. Thao said that in April 2001, she started working at the company and signed an <\/span>indefinite<\/span><\/a>–<\/span>term<\/span><\/a> labor <\/span>contract<\/span><\/a><\/p>\n

After 19 years of working, although she always completed the work and didn\u2019t\u00a0 violate labor discipline, on April 24, 2020, she received a notice to unilaterally terminate the company’s labor contract. On June 17, the company issued a decision to let Ms. Thao quit on June 15. <\/span>The<\/span><\/a> reason<\/span><\/a> given<\/span><\/a> by<\/span><\/a> the<\/span><\/a> company<\/span><\/a> is <\/span>that<\/span><\/a> it<\/span><\/a> is <\/span>facing<\/span><\/a> difficulties<\/span><\/a> because<\/span><\/a> of<\/span><\/a> the<\/span><\/a> COVID-19 <\/span>epidemic<\/span><\/a>, <\/span>forced<\/span><\/a> to<\/span><\/a> shrink<\/span><\/a> production<\/span><\/a> and<\/span><\/a> reorganize<\/span><\/a> labor.\u00a0<\/span><\/p>\n

However, Ms. Thao didn\u2019t agree with this decision. According to her, before and after unilaterally terminating the labor contract with her, the company still recruited more workers. Therefore, Ms. Thao complained but wasn\u2019t resolved by the company, so she decided to sue for compensation.<\/span><\/p>\n

Mr. Duong Van Thuan, an officer of the Ho Chi Minh <\/span>City<\/span><\/a> Labor <\/span>Federation<\/span><\/a> Legal<\/span><\/a> Consultancy Center was <\/span>sent<\/span><\/a> to<\/span><\/a> the<\/span><\/a> trial<\/span><\/a> as<\/span><\/a> a<\/span><\/a> defender<\/span><\/a> of<\/span><\/a> the<\/span><\/a> legitimate<\/span><\/a> rights<\/span><\/a> and<\/span><\/a> interests <\/span>of<\/span><\/a> the<\/span><\/a> workers. Through meetings and negotiations in court, on August 3, 2022 between the company and the employee, an agreement was reached on the settlement of the case without going through a trial. Accordingly, the company\u00a0 agreed to compensate Ms. Thao 242 million dongs for unilaterally terminating the labor contract against the law.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
