Foreign workers working for more than 3 months at enterprises in Vietnam are required to apply for a work permit and sign a labor contract.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The work permit is issued by the Department of Labor, War Invalids, and Social Affairs. color: #ff0000;\"><b>Enterprises and organizations are guaranteed to issue work permits<\/b><\/span><\/h1>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Enterprises operating under the Enterprise Law, Investment Law, or international treaties to which the Socialist Republic of Vietnam is a signatory;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contractors participating in bids and performing contracts;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Representative offices, branches of enterprises, agencies, and organizations licensed to be set up by competent agencies;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">State agencies, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A foreign non-governmental organization that is granted a registration certificate by a competent Vietnamese agency in accordance with Vietnamese law;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-business organizations and educational institutions established in accordance with law;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">International organizations, offices of foreign projects in Vietnam; agencies and organizations permitted to be established and operated by the Government, Prime Minister, ministries, and branches in accordance with law;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The operating office of the foreign investor in the business cooperation contract or of the foreign contractor is registered to operate in accordance with the law;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To organize law practice in Vietnam according to the provisions of the law;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cooperatives and unions of cooperatives established and operating under the Law on Cooperatives;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Business households and individuals are allowed to conduct business in accordance with the law.<\/span><\/li>\n<\/ul>\n<h1 style=\"text-align: justify;\"><span style=\"color: #ff0000;\"><b>Conditions for obtaining a work permit<\/b><\/span><\/h1>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\"><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/slflaw.vn\/dich-vu-xin-visa-the-tam-tru-va-giay-phep-lao-dong\/\">To apply for a work permit<\/a><\/span>, a foreign worker must meet the following conditions:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foreign workers must have full civil act capacity as prescribed by law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foreign workers must have health suitable for the job requirements.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foreign workers must not be criminals or be examined for penal liability in accordance with Vietnamese and foreign laws.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The foreign worker must be a manager, executive director, specialist or foreign worker technical<\/span><span style=\"font-weight: 400;\"> documents, have all the proofs as prescribed in Article 3 of Decree 152 as follows:<\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For specialist positions:<\/span><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">University degree or higher and verification of at least 3 years of working experience in the training major suitable to the job position in which the foreign worker is expected to work in Vietnam.<\/span><span style=\"font-weight: 400;\">Consular authentication<\/span><span style=\"font-weight: 400;\">;
