PROCEDURES FOR APPLYING FOR VIETNAM VISA AND VISA FOR FOREIGNERS WORKING IN VIETNAM
– Tourist Visa (symbol DL): this is the face entry visa to Vietnam for tourism purposes, visiting for a maximum stay of 3 months, the number of times of entry depends on the type of foreigner visa If granted, in the case of foreigners holding US citizenship, the visa period can be up to 1 year.
– Working Visa: granted to people foreigners who enter Vietnam for the purpose of working, and technical training with foreign-invested companies in Vietnam, the maximum term of this type is 1 year. The symbol of this type of visa is DN.
– Work visa (symbol LD): This type of visa is granted to foreigners entering Vietnam to work. To apply for this type of visa, foreigners must have a Work Permit.
– Visa to visit relatives (symbol TT): Foreigners who have relatives (father, mother, wife, husband, children) who are Vietnamese nationals will apply for this visa for the purpose of visiting relatives. The first condition to apply for this type of visa, foreigners must have documents proving their relationship, and the maximum period of being granted a family visit visa is 1 year.
Work permit for foreigners working in Vietnam
Currently, in order to be granted an entry visa to Vietnam, foreigners need to meet the following 4 basic conditions:
– Original passport of the foreigner with international travel validity of more than 6 months
– There are individuals, agencies, enterprises, and organizations in Vietnam inviting, guaranteeing…
– Foreigners who do not fall into the cases banned from entry according to the provisions of Vietnamese law
– Foreigners entering Vietnam to work must have a guarantor company and documents proving the purpose of entry such as a practice license, employee card, the invitation to attend a conference, etc.
– Investor with investment certificate, and capital contribution.
– Entry by visiting relatives must be sponsored by relatives and prove the family relationship and provide proofs such as marriage certificate, birth certificate, household registration, etc.
– Entry under the tourist category will have to consider the travel history of having traveled to advanced countries or not (except for cases exempted from visas, on the list of countries that are granted Vietnam e-visas).
– Entry under the study abroad category with a written receipt from the school or educational institution of Vietnam if entering for the purpose of the study.
The process of applying for an entry visa by direct form includes the following 3 steps:
Step 1. Prepare documents according to regulations;
Step 2. Apply for an entry letter for foreigners:
Submit your application at one of the three headquarters of the Immigration Department (Department of Immigration Control) – Ministry of Public Security:
– In Hanoi: 44-46 Tran Phu Street, Ba Dinh, Hanoi;
– In Da Nang: 7 Tran Quy Cap Street, Hai Chau District;
– In the city. HCM: 333-335-337 Nguyen Trai, District 1, City. HCM.
Step 3. Get results.
The time limit for the processing and issuance of visas by the RCA (from the date of receipt of complete and valid dossiers):
– No more than 5 working days: For foreigners receiving visas at Vietnamese representative missions abroad;
– No more than 3 working days: For foreigners receiving visas at international border gates;
– Within 12 hours: Apply in case of attending a relative’s funeral or a loved one who is seriously ill; enter Vietnam to handle urgent matters according to regulations.
Note: Foreigners applying for NG1, NG2, NG3, NG4 visas need to go through an inviting or guaranteeing agency or organization to send a written request for a visa to a competent agency of the Ministry of Foreign Affairs.
Step 1: Access and enter information at the Vietnam Immigration Portal;
Step 2:Pay the electronic visa fee (25 USD) after receiving the electronic application code;
Step 3:Get results:
– Within 3 working days (from the date of receipt of complete information and costs), the immigration authority will notify the results;
– If approved, foreigners use the electronic profile code to check and print the electronic visa to enter Vietnam.
Visa for foreigners working in Vietnam is a type of long-term visa granted by the Government of Vietnam to foreigners for the purpose of work and is applied to those who are eligible for a work permit or are eligible. working in accordance with the provisions of the Labor Law of Vietnam.
The maximum duration of a work visa is from 3 months to 1 year (12 months).
Note: In case foreigners want to apply for a type of visa longer than 12 months (1 year), they can carry out the procedures to apply for a temporary residence card according to regulations with a term from 1 year to 10 years depending on the case.
– Law No. 47/2014/QH2013 – Law on entry, exit, transit, and residence of foreigners in Vietnam
– Circular No. 04/2015/TT-BCA stipulating the visa application form, temporary residence visa for foreigners
– Decree 152/2020/ND-CP detailing the management of foreign workers, granting work permits to foreigners working in Vietnam
– Operation license of the enterprise or organization (Business registration, investment license, operation license of the branch, representative office… submit the application at the Immigration Office)
– Certificate of use of seal sample or Notice of use of seal of the enterprise or organization with the business registration agency.
– The document introducing the seal, and signature of the authorized person of the organization (NA16). (Submit this declaration in case the company first submits the application at the Immigration Office)
– Application form for visa, the extension of temporary residence (NA5).
– The original passport is still valid as prescribed.
– A certified copy work permit (for LD2 visa) or Work permit exemption certificate for cases exempt from work permits (for LD1 visas)
– Temporary residence book or Certificate of temporary residence of foreigners (In some cases, the Immigration Office will require it)
Note: Particularly for foreigners who are Chinese and Taiwanese, are required to provide an additional 3cmx4cm photo to be granted a separate visa.
The time to carry out procedures according to current regulations is 05 working days from the submission date of valid dossiers. The time to receive the visa result will be specified in the receipt when the business or organization submits the application at the one-stop department at the Immigration Department.
